Employment Eligibility Verification (E-Verify)

Employment Eligibility Verification, commonly known as E-Verify, is an online system used by employers to confirm that a new employee is authorized to work in the United States. It compares information from the employment eligibility verification form, Form I-9, with records maintained by the Social Security Administration (SSA) and the U.S. Department of Homeland Security (DHS), along with data from U.S. Citizenship and Immigration Services (USCIS).

E-Verify operates under federal requirements established by the Immigration Reform and Control Act of 1986 (IRCA). Employers must first complete the I-9 form, verifying an employee's identity and work authorization using approved documentation. These may include driver’s licenses, a Social Security number, an employment authorization document or a green card for a lawful permanent resident. After the completed form is finalized, employee data is submitted through the E-Verify program to confirm employment authorization and validate identity.

The system returns results that confirm eligibility or identify discrepancies. If a mismatch occurs, a Tentative Nonconfirmation may be issued, requiring follow-up. E-Verify supports compliance with federal law and aligns with oversight from agencies tied to customs enforcement while helping employers maintain accurate records and manage verification steps tied to onboarding and retention.

Key Reasons HR Leaders Use E-Verify

E-Verify supports human resources (HR) teams in managing compliance and improving hiring accuracy. It adds an additional verification step beyond Form I-9 and helps standardize employment eligibility verification across the organization.

Common reasons organizations use E-Verify include:

  • Confirming employment authorization using federal databases

  • Reducing compliance risk tied to work authorization errors

  • Supporting audit readiness and documentation accuracy

  • Improving consistency across onboarding workflows

  • Verifying new hires and rehires within required business days

Using E-Verify helps HR leaders align hiring practices with federal requirements while maintaining clear documentation.

Who Is Required to Use E-Verify?

E-Verify is not mandatory for all employers, but certain organizations must use it based on federal or state requirements. This often includes federal contractors and employers operating under mandates tied to the U.S. Department of Homeland Security and immigration enforcement standards.

Employers required to use E-Verify typically include:

  • Federal contractors and subcontractors

  • Employers in states with E-Verify laws

  • Organizations that voluntarily adopt the system

Many employers choose to participate to strengthen compliance practices and reduce risk.

Difference Between E-Verify and Form I-9

E-Verify and Form I-9 are closely related but serve different roles in the employment eligibility verification process.

Key differences include:

  • Form I-9 is required for all employers and documents identity and work authorization

  • E-Verify confirms I-9 data against federal systems

  • Form I-9 relies on document review such as lists of acceptable documents, including List A, List B and List C

  • E-Verify provides electronic confirmation through DHS and SSA systems

Form I-9 establishes eligibility, while E-Verify confirms it through federal records.

Using E-Verify in HR Operations

Integrating E-Verify into HR workflows helps standardize onboarding and reduce manual errors. It is typically used after completing Form I-9 and within required timelines tied to the employee’s first day of work.

HR teams often use E-Verify by:

  • Submitting employee information within required timeframes

  • Tracking results and managing follow-up actions

  • Managing reverification and monitoring expiration date requirements for work authorization

  • Maintaining records for compliance and retention

Employers may also rely on guidance from the handbook for employers and use authorized representatives when completing verification steps for remote or distributed teams. Technology platforms that integrate Form I-9 and E-Verify help improve efficiency and support consistent HR operations.

Employment Eligibility Verification FAQs

These answers address common questions about how E-Verify works and how it supports employment eligibility verification.

Employment eligibility is verified by completing Form I-9 and reviewing documents that confirm identity and work authorization. These may include documents such as a Social Security card, birth certificate or other acceptable forms listed in federal guidance. After completing the form, employers may use E-Verify to confirm the information against federal systems. This step helps validate that employee records match government data.
