New EEOC Requirement—A Must for All Employers

The way (and where) we work has changed—and regulatory agencies are starting to adapt. For years, the Equal Employment Opportunity Commission (EEOC) required all covered companies to display an “EEO Is the Law” poster.

Recently, the EEOC released an updated “Know Your Rights: Workplace Discrimination is Illegal” poster, which features updated language, a QR code and digital copies for remote or hybrid workspaces. The change ensures that all employees know their rights and that all employers are aware of their responsibilities, whether the workplace is in-person, hybrid or fully remote.

The new “Know Your Rights” poster summarizes federal laws that prohibit job discrimination for employees, applicants and union members.

What's Included

The forms of discrimination include:

  • Age (40 and older)

  • Disability

  • Sex

  • Religion

  • Color

  • Race

  • National Origin

What’s Changed

Additionally, changes were made to ensure that legal rights and obligations are easily understood.

The changes include:

  • Simple language and straightforward formatting

  • A clarification that sex discrimination includes pregnancy and associated conditions, gender identity and sexual orientation

  • A note that harassment is an illegal type of discrimination

  • Information regarding equal pay discrimination for contractors

  • A QR code for quick access to file a charge

In a press release, the EEOC urges all employers to prominently display the poster at their worksites as soon as possible. The agency noted that covered employers will be subject to fines if they do not comply.
